Here are the details.<\/p>\n<p><span id=\"more-1057871\"\/><\/p>\n<h2 id=\"h-judge-sets-aside-prosser-s-default\" class=\"wp-block-heading\">Judge sets aside Prosser&#8217;s error<\/h2>\n<p class=\"wp-block-paragraph\">Earlier this month, Jon Prosser&#8217;s attorney and Apple&#8217;s legal team agreed to ask the court to set aside the lawsuit against him after Prosser failed to respond to Apple&#8217;s complaint within the court&#8217;s deadline.<\/p>\n<p class=\"wp-block-paragraph\">From the document:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">WHEREAS, due to Mr. Prosser&#8217;s latest consultant and rapid production agreement, Apple believes that setting aside the automatic installation is the most effective way to proceed with this case without further delay, and Apple is not opposed to setting aside the automatic installation;<br \/>NOW, THEREFORE, Apple and Mr. Prosser state, subject to the confirmation of the Court, that filing a case of non-payment of Mr. Prosser is set aside.<\/p>\n<\/blockquote>\n<p class=\"wp-block-paragraph\">Shortly after the filing in April, Prosser&#8217;s attorney informed the court that he intended to vacate the case and present &#8220;evidence of an appropriate defense to Apple&#8217;s claims.&#8221; Prosser and Apple later submitted their joint terms on June 9.<\/p>\n<p class=\"wp-block-paragraph\">Apple sued Jon Prosser alongside Michael Ramacciotti last July, alleging that Ramacciotti received a development iPhone for former Apple employee Ethan Lipnik while Lipnik was away. The company alleges that Prosser used the information obtained from Lipnik&#8217;s iPhone to publish videos that revealed the features of what would become Liquid Glass.<\/p>\n<p class=\"wp-block-paragraph\">According to court documents filed in the case, Ramacciotti was very cooperative with the adoption process, while Prosser failed to respond. Prosser later disputed the person&#8217;s interpretation that he did not ignore the case, saying that he &#8220;has been in contact with Apple since the early stages&#8221; of the case.<\/p>\n<p class=\"wp-block-paragraph\">However, the clerk then entered his default at Apple&#8217;s request, preventing Prosser from formally disputing the company&#8217;s allegations unless that default is set aside.<\/p>\n<p class=\"wp-block-paragraph\">After Prosser retained his attorney, his attorney and Apple agreed that a set aside would be the most effective way to move the case forward. At the beginning of this month, they jointly submitted a stipulation asking the court to do so.<\/p>\n<p class=\"wp-block-paragraph\">Today, US District Judge James Donato granted the request:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">IT IS ORDERED that the default entry for Jon Prosser be set aside. Mr. Prosser will have ten days after the date of this order to file a response to Apple&#8217;s complaint. Mr. Prosser will produce all materials in response to Apple&#8217;s prior discovery requests by June 9, 2026, and will complete the request no later than June 16, 2026.<\/p>\n<\/blockquote>\n<p class=\"wp-block-paragraph\">Interestingly, this order is dated June 22, even though the two deadlines it covers have passed. It is possible that the order was signed without reviewing these provisions.
